Terms of Service
These Terms of Service ("Terms") govern your access to and use of AgenticDerm, a clinical documentation and context workspace provided by Legit Health, S.L. ("Legit.Health", "we", "us"). AgenticDerm is offered as a product by Legit.Health. By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
1. Who we are
AgenticDerm is provided by Legit Health, S.L., a company incorporated in Spain. You can reach us at hello@legit.health. Full corporate identification and our data protection details are set out in our Privacy Policy.
2. The service
AgenticDerm is a workspace for dermatology in which each patient is a project: clinical images and documents on one side, the document you are writing in the centre, and an assistant that helps you organise and enrich the patient's context. The service helps you document, organise, and reason about clinical information. It is a tool to support your work; it does not practise medicine and it does not replace your professional judgement.
3. AgenticDerm is not a medical device
AgenticDerm is a clinical documentation and context-management workspace. It is not a medical device and it does not perform a medical purpose of its own. It does not diagnose, it does not measure disease severity, and it does not produce clinical determinations.
Where the service shows a severity measure, a differential diagnosis, or a similar medical determination, that determination is produced by the Legit.Health+ API, which is a certified medical device, and is attributed to it. AgenticDerm consumes and displays the device's outputs; it does not generate them.
The assistant may generate text that helps you read or summarise a case. Any such assistant output is clearly labelled, is non-medical and for information only, and is never presented as, or a substitute for, a medical determination. You must not rely on assistant output as a diagnosis, a severity measure, or any other clinical determination.
You remain solely and fully responsible for all clinical decisions, diagnoses, treatment, and patient care. Nothing in the service removes or reduces your professional and legal responsibilities as a healthcare professional.
4. Who may use the service
The service is intended for practising healthcare professionals acting in a professional capacity. To activate an account we verify that you are a practising clinician, and access is granted at our discretion. We may decline, suspend, or revoke access if we cannot verify you, or if these Terms are breached. You must be of legal age and able to enter into a binding contract.
5. Your account
You are responsible for the accuracy of the information you give us, for keeping your credentials secure, and for all activity under your account. Tell us promptly at hello@legit.health if you suspect any unauthorised use. Accounts are personal to you and may not be shared.
6. Patient data and privacy
When you use the service to process personal data about your patients, you (or the organisation you act for) are the data controller for that data, and Legit.Health acts as a data processor that processes it on your documented instructions, as described in our Privacy Policy and any applicable data processing terms. Patient data you store in the service is held within the European Union.
You warrant that you have a lawful basis and any consents or authorisations required to process patient data on the service, and that you will use the service in line with the professional, ethical, and data protection obligations that apply to you. You must not upload data you are not permitted to process.
7. Acceptable use
You agree not to: use the service unlawfully or for any purpose other than supporting legitimate clinical work; upload content you have no right to upload; attempt to probe, breach, or circumvent the security of the service; interfere with its operation or other users; reverse engineer the service except to the extent the law expressly permits; or use the service to build a competing product. You must not present assistant output as a medical determination to patients or third parties.
8. Your content
You keep all rights in the patient data and documents you put into the service. You grant us the limited rights needed to host, process, and display that content so we can provide the service to you, and to create backups and maintain the platform. We do not claim ownership of your clinical content.
9. Our intellectual property
The service, including its software, design, and content we provide, and the AgenticDerm and Legit.Health names and marks, belong to Legit.Health or its licensors. These Terms do not grant you any right in them beyond the right to use the service while these Terms are in force.
10. Availability and changes to the service
AgenticDerm is offered on an early-access basis and is being actively developed. We may add, change, or remove features, and we may set or change fees on reasonable notice. We aim for a reliable service but we do not promise it will be uninterrupted or error free.
11. Disclaimers
To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service, or any assistant output, is accurate, complete, or suitable for any clinical purpose. The service does not provide medical advice and is not a substitute for the judgement of a qualified healthcare professional.
12. Limitation of liability
To the fullest extent permitted by law, Legit.Health is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or related to your use of the service. Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability arising out of or related to the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the liability.
13. Indemnity
You agree to indemnify Legit.Health against claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of the service, or your processing of patient data in breach of the obligations that apply to you.
14. Suspension and termination
You may stop using the service and close your account at any time. We may suspend or end your access if you breach these Terms, if we are required to by law, or if continuing to provide the service to you would create a security or legal risk. On termination, the rights granted to you end; the clauses that by their nature should survive (including sections 8, 9, 11, 12, 13, and 16) continue to apply.
15. Changes to these Terms
We may update these Terms. When we do, we will change the version and effective date above, and where the change is material we will give reasonable notice. If you continue to use the service after a change takes effect, you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of Spain. Disputes that cannot be resolved amicably are subject to the jurisdiction of the competent courts of Spain, without prejudice to any mandatory consumer protections that may apply to you under your local law.
